1. About us
1.1 Atelier Papel is registered in England and Wales under company name RYC Ltd and company number 11640922.
1.2 The following Terms and Conditions of Service apply to all products and services provided by Atelier Papel.
2. General
2.1 Please carefully read these Terms and Conditions before using the https://www.atelierpapel.com website operated by Atelier Papel (the “Service”).
2.2 Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms and Conditions and our Privacy Policy (collectively the “Terms”). These Terms apply to all visitors, users and others who access or use the Service.
2.3 Atelier Papel carries out all work on the understanding that the client has agreed to Atelier Papel’s Terms.
2.4 Copyright is retained by Atelier Papel on all creative design work including all illustrations and bespoke designs unless specifically released in writing and after all costs have been settled.
2.5 If a choice of designs is presented to the client and the client only picks one design, the remaining designs remain the property of Atelier Papel, unless agreed in writing that this arrangement has changed.
2.6 By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access the Service.
3. Project acceptance
3.1 At the time of proposal, Atelier Papel will provide the client with a written estimate or quotation, such estimate or quotation will be in accordance with these Terms.
3.2 The client may send an official order in reply to the estimate, quotation or an email acknowledging acceptance of the quotation, which will bind the client to accept Atelier Papel’s Terms.
3.3 Work will not commence on a project until Atelier Papel has received acceptance of the quotation.
4. Payment
4.1 Existing Designs: Clients will receive an invoice once item quantities have been finalised. Full payment must be made prior to the designs being sent to print.
4.2 Illustrated and Bespoke Designs: Clients will receive an invoice for the agreed design fee. This design fee must be paid in full prior to the commencement of any design work on the project. Following payment of the design fee, a further invoice will be issued once item quantities have been finalised. Full payment of this invoice must be made prior to the designs being sent to print.
5. Copyrights and Trademarks
5.1 By supplying text, images and other data to Atelier Papel for inclusion in the client’s designs or other medium, the client declares that it holds the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with the client, or rightful copyright or trademark owner.
5.2 Any illustrations, designs, or text supplied and/or designed by Atelier Papel on behalf of the client, will remain the property of Atelier Papel and/or its suppliers in accordance with the Copyright, Designs and Patents Act 1988.
5.3 The client may request in writing from Atelier Papel the necessary permission to use materials (for which Atelier Papel holds the copyright) in forms other than for which it was originally supplied, and Atelier Papel may, at its discretion, grant this. Such permission must be obtained in writing before it will allow any of the aforementioned illustrations, artwork, images, text, or other data to be used.
5.4 By supplying images, text, or any other data to Atelier Papel, the client grants Atelier Papel permission to use this material freely in the pursuit of the design.
5.5 The client agrees to fully indemnify and hold Atelier Papel free from harm in any and all claims resulting from the client in not having obtained all the required copyright, and/or any other necessary permission.
6. Alterations
6.1 The client agrees that changes required over and above the estimated work or required to be carried out after acceptance of the draft design will be liable to a separate charge.
6.2 The client also agrees that Atelier Papel holds no responsibility for any amendments made by any third party before or after a design is published.
7. Licensing
7.1 Any design, illustration, idea created for the client by Atelier Papel, or any of its contractors, is licensed for use by the client on a one-time only basis and may not be modified, re-used, or re-distributed in any way or form without the express written consent of Atelier Papel.
7.2 The client should register all design work, where there is a risk that another party make a claim, with the appropriate authorities prior to publishing or first use or searches and legal advice sought as to its use.
7.3 Atelier Papel will not be held responsible for any and all damages resulting from such claims. Atelier Papel is not responsible for any loss, or consequential loss, non-delivery of products or services, of whatever cause.
7.4 The client agrees not to hold Atelier Papel responsible for any such loss or damage. Any claim against Atelier Papel shall be limited to the relevant fee(s) paid by the client.
8. Rights of refusal
8.1 Atelier Papel will not include in its designs, any text, images or other data, which it deems to be immoral, offensive, obscene or illegal.
8.2 Atelier Papel also reserves the right to refuse to include submitted material without giving reason.
8.3 In the situation where any images and/or data that Atelier Papel does include in all good faith, and subsequently discovers is in contravention to such terms and conditions, the client is obliged to allow Atelier Papel to remove the contravention without hindrance, or penalty.
8.4 Atelier Papel is to be held in no way responsible for any such data being included.
9. Cancellation
9.1 Cancellation of orders may be made initially by telephone contact or e-mail, however, following this, Atelier Papel will need formal notification in writing to the company’s postal address.
9.2 The client will then be invoiced for all work completed over and above the non-refundable deposit that will have been made at the time of first ordering. The balance of monies due must be paid within 21 days.
9.3 Please note: any cancellation which is not formally confirmed in writing and received by Atelier Papel within 14 days of such instruction being issued, will be liable for the full quoted cost of the project.
10. Project duration
10.1 Any indication given by Atelier Papel of a project’s duration is to be considered by the client to be an estimate. Atelier Papel cannot be held responsible for any project over-runs, whatever the cause.
10.2 Estimated project duration should be deemed to be from the date that Atelier Papel receives funds for the initial payment or by date confirmed in writing by Atelier Papel.
11. Refunds, returns and reprints
11.1 It is not possible to return products for refund other than in the event of an order being produced to the wrong order specification or not to an acceptable standard.
11.2 In either of these cases Atelier Papel may (at our discretion) reprint free of charge.
11.3 Any errors in printing must be reported via e-mail to the following email address info@atelierpapel.com, please make sure to include your invoice/reference number in the subject line.
11.4 In order to qualify for a full refund you will need to email Atelier Papel within 3 days of order receipt. Atelier Papel will also require you to return a sample or photographic evidence of the issue.
11.5 Atelier Papel will notify you of any refund due to you via email within a reasonable period of time and will usually process the refund due to you within 30 days of the day Atelier Papel confirmed to you that you were entitled to a refund.
11.6 We will refund the price of a defective product in full, any applicable delivery charges, and any reasonable costs you incur on returning the item to Atelier Papel.
11.7 Atelier Papel recommends that prior to placing an order, a sample product be purchased. This allows you to assess the quality of any designs, materials used and printing standard.
11.8 If the packaging of your order has been damaged, please accept the material from the courier and write on the document provided that you have accepted the package subject to checking. Once you have verified damage has occurred to the material inside the package you must email info@atelierpapel.com with photographic evidence of the damage before a reprint/refund is issued.
12. Fees and additional costs
12.1 Fees shall be agreed prior to commencement of work and will be payable on invoice on our standard terms of 21 days.
12.2 Failure to meet payment terms will result in withdrawal of design services by Atelier Papel. A 50% deposit will be taken when the order is confirmed, and the remaining balance will be required once project is complete and ready to go to print.
12.3 Invoices will be subject to a 1.5% per month interest charge if payment is not made within 21 days.
13. Changes
13.1 We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new Terms taking effect. What constitutes a material change will be determined at our sole discretion.
14. Termination
14.1 We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
14.2 All provisions of the Terms, which by their nature should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
